House Provider Status Bill Expected Soon

NACDS continues to make progress on advancing provider status in the 115th Congress. Last week, The Pharmacy and Medically Underserved Areas Enhancement Act (S. 109) was reintroduced with the bipartisan original co-sponsorship of more than a quarter of the Senate.

The cosponsors would like the bill to retain its number from the previous Congress—H. R. 592.

The return of the legislation in the House is expected shortly, where the bill currently has more than 100 original cosponsors. The cosponsors would like the bill to retain its number from the previous Congress—H. R. 592. In order to do that, the cosponsors will need to introduce the legislation right after a bill numbered H.R. 591, which should not take too long. The House is not in session this week, so it’s possible the bill could be formally reintroduced in the House next week.

Rep. Brett Guthrie (R-KY) met with Co-Chief Operating Officer of Walgreens Boots Alliance Alex Gourlay, NACDS vice chairman, at the 2016 NACDS RxIMPACT Day on Capitol Hill. Rep. Guthrie was a lead sponsor of NACDS-backed pharmacist provider status legislation in the previous Congress, and will be one of the members re-introducing the bill in the House in the coming days. The bill was reintroduced in the Senate on Thursday with the bipartisan original co-sponsorship of more than one-quarter of the Senate.

The newly convened 115th Congress has started to announce congressional committee assignments. Significantly for NACDS, Rep. Buddy Carter (R-GA), the only pharmacist currently serving in Congress, landed a sought-after seat on the House Energy and Commerce Committee and its Health Subcommittee.

In the Senate, freshman Sen. Todd Young (R-IN), who was an original cosponsor of the Pharmacy and Medically Underserved Areas Enhancement Act in the prior Congress, was named as a member of the Senate Committee on Health, Education, Labor and Pensions.

The legislation would enhance underserved Medicare patients’ access to state-approved pharmacist services. The lead sponsor of the bill in the 114th Congress, Rep. Brett Guthrie (R-KY), will remain vice chairman of the House Energy and Commerce Committee’s Health Subcommittee. It is encouraging that these congressional pharmacy supporters are well placed, especially as Congress prepares for reforms to the Affordable Care Act.

Arlington, Va. – The Pharmacy and Medically Underserved Areas Enhancement Act (S. 109) was reintroduced today with the bipartisan original co-sponsorship of more than one-quarter of the U.S. Senate. The return of the legislation in the U.S. House of Representatives also is anticipated shortly. The National Association of Chain Drug Stores (NACDS) strongly backs the legislation.

We want today’s bill re-introduction to serve as an acceleration, and not just a continuation, of the campaign to enhance the quality, accessibility and affordability of patient care through pharmacist-provided services.

The bill would allow underserved Medicare patients to receive certain services from pharmacists, in states in which pharmacists already are permitted to administer the functions. Examples of these services include immunizations; helping seniors manage chronic conditions such as diabetes, heart conditions and asthma; conducting wellness or prevention testing; and helping seniors take their medications correctly and as prescribed. Nurse practitioners and physicians’ assistants currently can provide these services through Medicare.

“Pharmacists remain among the most highly trusted professionals. That, combined with their extensive education and accessibility, create tremendous opportunities for patient care,” Anderson said.

NACDS Previews “Pharmacy Outlook 2017” in Chain Drug Review Call to action includes engagement in NACDS RxIMPACT Day on Capitol Hill

The opening line of an NACDS-authored article in the January 2, 2017, edition of Chain Drug Review says it all. “I will spare you the introductory paragraph that attempts eloquence,” writes NACDS President & CEO Steven C. Anderson, IOM, CAE. “Let’s get right to the point. In NACDS’ view, 2017 could be one of the most pivotal years in healthcare policy and in pharmacy patient care.”

NACDS already is waging a two-front campaign related to the ACA.

While NACDS’ article on the policy outlook for the coming year has become somewhat of an annual tradition, its content this time around is decidedly untraditional. For example, Anderson noted the importance of continuing to bird-dog the implementation of pharmacy provisions of the Affordable Care Act and its subsequent Executive Branch rules, while at the same time advocating for pharmacy’s perspective amid emerging efforts to somehow repeal and replace the law.

NACDS is proactively urging support in the 115th Congress for the Pharmacy and Medically Underserved Areas Enhancement Act (H.R. 592/S. 314), which would increase access to state-approved pharmacy services for underserved Medicare patients.

As part of The Patient Access to Pharmacists Care Coalition, NACDS RxIMPACT launched a membership-wide grasstops campaign to encourage NACDS member companies to build congressional support for the re-introduction of the legislation in January 2017. There is also a letter currently circulating in the House of Representatives from Reps. Brett Guthrie (R-KY) and G.K. Butterfield (D-NC) urging their colleagues to support the legislation by becoming original cosponsors of the bill, which at the end of the 114th Congress had 296 cosponsors in the House and 51 in the Senate, an excellent show of bipartisan and bicameral support.

When the 115th Congress convenes in January, it will welcome 63 newly-elected members of Congress from 28 states. The letter provides compelling reasons to support the bill, noting that with 30 million Americans set to enroll in Medicare over the next two decades, it will be harder for patients to access care in their communities and the impact will be felt by those who can least afford it: the nation’s medically underserved populations. Emphasizing pharmacy’s untapped potential for underserved populations, the letter states that 86 percent of Americans live within five miles of a pharmacy.

There are currently nine cosponsors in the Senate and 35 in the House who have agreed to cosponsor the legislation in the 115th Congress.

Gourlay, who is a pharmacist, provided perspective as a chain member about the importance of the work NACDS does. Gourlay said NACDS is well positioned to respond to a rapidly changing world and noted that the need for healthcare will grow and, along with it, pharmacy will as well. He pointed out that pharmacists are so well trained, especially in the United States, but they are not fully utilized and so the advocacy work NACDS does to expand pharmacists’ scope of practice is so important.

Gourlay also praised the effectiveness of NACDS meetings and recounted the first time he attended an NACDS Annual Meeting. He said, “It blew my mind to see so many people in one place with a real passion for the industry.” He emphasized that NACDS’ job is to reiterate “the value that pharmacy brings to the patient and the value NACDS brings to its members.”

Byrne was not aware of the legislation previously. John Greene, RPh, the pharmacy district manager for Southeastern Grocers LLC, said, “The topics were eye-opening to the congressman and I could tell he enjoyed having his knowledge enhanced about these areas.” The pharmacy team also covered other services pharmacists provide, including immunizations and medication therapy management. Greene said there was a lot of “positive interaction” between the staff and the congressman.

Rep. Chris Collins (R-NY) participated in an NACDS RxIMPACT pharmacy tour of a Rite Aid in Lancaster, N.Y., on Monday. The congressman asked the pharmacy team several questions about the opioid epidemic, which he knows a lot about as a member of the House Energy and Commerce Committee. Collins recently released a statement lauding the House passage of 18 pieces of legislation to combat the nation’s opioid epidemic during the week of May 9, 11 of which were passed out of the House Energy and Commerce Committee. Collins said, “There is no silver bullet to fix this issue, but the bipartisan legislative items passed this week will help communities across America educate individuals about the dangers of opioid abuse and work to eradicate this severe epidemic.”
